I am a landlord and we just signed a 1 year lease agreement on December 5th with a new tenant with a move in date of December 15th.  They gave us a check with the rent pro-rated for the month of December as well as the security deposit.  We received a call today that they are concerned that they won't be able to make rent every month and want to break the lease.  They have not taken possession of anything.  By law what is our course of action?  We don't want to be hard on them but we have removed all forms of advertising since we rented it out.  Now we are trying to get a tenant at Christmas!  What would you advise as a compromise?  Thanks!

Since they signed the lease and tendered payment, they are obligated to the terms of the contract they signed.  If you wish to let them out, agree to a one or two month termination fee to end the lease without further obligation to them.  Hope you cashed that check already!  I have the idea you will never get another penny.
