I am familiar with the SCRA. I have a tenant who has four months remaining on their current lease. The military husband has been deployed for almost a year with the family remaining in the home, he will return 60 days from now, and the wife has recently signed a contract on a home they wish to purchase. The wife believes they may terminate the lease early for any reason and at any time since her husband was deployed.  At this point they have not provided written notice of anything, but if and when they do, does the SCRA apply here even though the breaking of the lease has nothing to do with the husband being deployed? Thanks for any help on this one.

The SCRA  "Provides a servicemember who receives permanent change of station orders or who is deployed to a new location for 90 days or more the right to terminate a housing lease. "  Has this service member been moved or redeployed recently?   If not, I don't see how it applies.  Ask to see a copy of the order if you don't want to allow them out early.  However, you may want to reconsider.  He has been serving his country for the last year.  Their lease is almost over anyways.  Prime rental season is fast approaching so it may be easy to re-rent the property.
