I have a unique situtation. Our home worth over a half a million dollars was put up for sale so we could ove into the city. After being on the market for well over a year it did not sell. We offered the house for lease and a couple offered to lease the home with a possibility of purchasing the home during the 12 month lease. After about 6 months the couple notified the property manager that they had decided not to purchase the home and that we could put the house on the market if we so desired as long as we gave them 24 hour notice prior to each showing and they were given a 30 day notice from the date an offer was accepted.
We put agreed to this (not in writing) and put the house up for sale. It sold very quickly this time. The offer was accepted at the end of April and a loan closing has been set for July 3rd. The tenants have informed us that they want to be leave at the end of May. Can we legally hold the tenants to the lease until the end of June and then hold the closing on July 3rd with the new buyers? The signed lease contract was to end on August 31st. If they leave at the end of May, can I force them to pay rent for June based on a binding contract? or was the contract broken by us when we put the house on the market and sold it? Saling the house was not officially part of their lease.
