My Dad was killed in a hit and run accident on Apr 29. He had 2 roommates, mother and son, on a month to month lease. The lease, signed by them, and also listing me as my Dad's agent, was dated May 15, 2012. I gave them a 30 day notice on May14, 2013. They say they've been there a year, so they're entitled to a 60 day notice. They've also notified me, by text, that they've changed the locks and need 3 days notice to enter the house...only when they are there. They might be right in normal circumstances, but Dad's dead! His legal paperwork, VA, Social Security, RENT RECEIPTS, insurance papers, all are locked in his bedroom closet! Oh, there's no proof that they paid May's rent. Of course, they say they did, but Dad's receipt book shows no such payment, and every other month does! Does death of the landlord, if he actually lived in the house, make a difference? I'm overwhelmed with the ramifications of his death; I want them to move so I can move into Dad's house!

I'm in Riverside CA, Dad had no will, probate here I come!

Oh, and today they changed the locks! These are room renters on a month to month lease

Do yourself a favor and just let an attorney who specializes in evictions deal with this. sounds like too much to deal with  right now & once you have an attorney make contact they will get that you are not playing games. good luck
