When renting to a tenant most landlords have a lease in place. After a lease expires and a tenant goes month to month do the terms and condition of the lease still apply to the tenant?


I'm unclear of what governs the relationship besides the state tenant-landlord act at that time.

Once a lease reverts to a "Month-to-month", it should remain almost exactly the same, as long as it is written correctly. The big difference is that the length of tenancy and rent amount are no longer fixed.

You are now free to raise the rent or notify the tenant to move, with proper notice on both.

Read your document completely and consult a real estate attorney in your state if you still have questions.
