Move out date is today. Office closes at 5pm. Tenant will not be moved out until later tonight, however a move out inspection needs to be performed and no one will be available to inspect the apartment after office is closed. The Lease states that if Tenant moves out after agreed upon date an additional months rent will be charged. In this case is it legal to charge the tenant an extra months rent for failing to move out by agreed upon date?

you can charge (depends on state), up to the time you get it re-rented

The lease says if they move out after the agreed upon date.  It doesn't say by 5pm on that date.  They could legally move out by 11:59pm and still be out on that date.  Have a drop slot they can put keys in if they leave after hours.  Do the walk through after they are out on the next business day.  The condition won't change.  Take photos and document the damages.  Do the deposit statement within the specified time.
