I am the unit owner/landlord and I was looking for a roommate.  I found an applicant and gave him a lease to sign 2.5 weeks ago.  He knows he is to return the lease with the security deposit before he can move in.  I have not signed the lease yet, so it is unofficial, correct?  However, I do not have the lease, deposit or application and he is supposed to move in, in 5 days.  He told me he would be having a new bed delivered on July 5th on his move-in day.  I plan on not accepting the bed unless I get the application, signed lease and deposit.  If he happens to bring the security deposit check by on that day, should I tell him he still can't move in until the check clears?  I'm starting to not feel comfortable with this guy (who I would be living with on a daily basis).  With no signed contract or anything else, do I have a right to tell him I just don't feel comfortable?  Any advice??

My opinion: Follow your gut instinct and cancel before he gets there.

Have you tried to "call him" ?

I dont understand what is causing you to have issue as sometimes in the complex process of preparing to move things get overlooked.  I could see if you called him and something happened but nothing has.

Call him and remind him of what needs to be done and see what he says.  Explain he can not move in until this is done and if done at the last moment, he would have to have a certified check or cash only.

Then if its not what you want, tell him its unacceptable and its done.

You didn't sign that lease did you?  Sure hope not.  He can sign it at any time if you did.

If not, you can cancel the lease whenever. It was never signed.  No agreement was made.  No money changed hands.  If you don't have the lease and money when the bed comes, I'd reject it too.  You don't have a contract with this guy until you have that lease.

I agree to call him.  Let him know you must have that signed lease and the money (not a personal check - only certified funds) before the bed arrives.  Otherwise the contract is cancelled and you rent to someone else.

Well, I had been calling him for weeks and days before the day he was supposed to move in and I had received no answer (generally no response back from him).  I was about to do a background check on him and that's when he told me that he was arrested 5 years ago for forging doctors prescriptions for pain killers.  That's when I told him that I don't feel comfortable letting him move in.  Since I had received no contract or security deposit on the date he told me he would have it, then after hearing that, it made me think that he's still doing it.  I never sign the lease before I give it to a roommate, so it was never signed on my behalf.
