I live in Maryland and rented my property to a married couple. Before the lease expired the husband moved out of the house. I signed a new lease with just his wife after the old lease expired. The old lease does not cover what happens in this situation. The husband has contacted me and wants half of the security deposit back based on a discussion with his lawyer.
I am not sure what to do? On the surface it makes sense to give the money back to the husband. In that case the wife will need to pay me the shortfall. On the net some suggest I send a check to both the husband and wife and let them fight it. Another suggest I keep the deposit until the unit is vacated. Help!
