Thank you in advance for any responses. This one is confusing at least for me. Tenants chose to break lease 4 months early. Notification given 3/1. I agreed to allow this if I could find a new tenant. Otherwise they would be responsible for the remaining 1-4 months depending on when the new tenants moved in.

I could not find anyone for 4/1, but new tenants now set to move in 5/1. Old tenants scheduled to move out in a few days. I am still looking to collect one more month. Payment was due 3/1. After a couple of follow up requests with no response I do not anticipate payment.

Should I still start the eviction process even though they will probably be moving out in a few days? No desire to actually evict them but want to make sure I file everything properly in the right order to potentially collect. I'm aware that the time and trouble probably won't be worth 1 month. I suspect they may have run this scam before though, so I at least want this going on their credit.

did they pay the rent, if not give they a pay or quit (days depends on your state...I am in Wisconsin 5 day)
they will owe up to the time you rent it (minus security deposit plus damage).
