Here is my story:

- Got new tenants in August 
- They paid the rent and security deposit no problem
- Made some upgrades to the property - we went 1/2 and 1/2 - looking like great tenants
- Paid their rent on time for September

Now come October:
- Sent them reminder text on Sept 30th (I know one of them read the text - they have reply receipts on)
- Called them on the 1st, left VMs
- Sent them a reminder text on the 3rd - that they will incur a late fee if payment isn't received by the 4th
- Mailed a letter to them via USPS Priority Mail on the 4th - will arrive on the 6th/today - stating they will be incurring a late fee - payment is due immediately or could potentially face eviction - included was the portion of the agreement, highlighted the pertinent portions 
- My lease agreement states: If the Tenant fails to pay rent when due, Property Owner may serve a seven (7) day notice to pay rent or vacate as provided by Michigan State law.


They have communicated with me no problem up until this date.  I've made some fixes/repairs to the property with turnover in 24-48 hours.

Now the communication has stopped.  Last time I was there was September 24th.

Just looking for any advice or recommendation on what I should do next?  My plan was to hold until the 8th, follow up with them with a text and phone call on the 8th if I don't hear anytime - If I don't, then I will send them a Notice to Quit for Failure to pay rent on the 9th via USPS Priority Mail with Signature confirmation.

I'm not sure how it is in Michigan, but in NYS you don't have to go through all that mess. Tenants know that they are supposed to pay rent. So if they're not communicating with out AND they haven't paid rent, it's because they don't want to pay or can't pay. I would simply file the eviction and get them out of there. The longer you wait, the worse it will get. I can promise you that.

It's been my experience too that as soon as tenants stop responding to your messages in all likelihood they don't have your rent. Quickly take the steps you outlined in their lease agreement, get that pay or quit notice up ASAP and see how quick they'll respond now.  [smile]
