Hi

I am sorry but this post may be long... Just a heads up

I am acting as a property manager for my mothers place in Wyoming. She wanted to rent to one of her granddaughters (My Niece). We have a lease. In November 2016, my niece asked her husband to leave the residence which he did but did NOT take his name off of the lease. In Jan 2017, my niece did NOT give notice to move but she did. Rent has not been paid since November 2016. My mother was worried about some of her belongings that were left at that particular house and asked me to secure the house (it is in the country). No one was living in the residence when I notified both parties on the lease that I was asked to secure the house - they had NOT secured the home when they left - they left one door open since they had boarded up the one door that had a key....I informed them that since neither one was living there and that rent had not been paid for December or January I was securing the house in three days....That did not go over very well.... I did lock the doors but then after researching more deeply I removed the locks and gave both tenants a 3 day notice to vacate. This 3 day notice to vacate was given to them on Thursday, Jan 19 and is to go to midnight Jan 24th. The male tenant has stated in many texts that he will have all of belongings out of the house on Saturday Jan 21. I don't know if he has done this or not.

My question is this - if when I go out to the place on Wednesday Jan 25th can I lock up the place at that time? Or if when I go out there and there is stuff still there, can I lock the place?

you have to file for eviction, next. then after judge grants it, you may have to secure the things

Doing an illegal eviction and just securing the place by locking the pre-existing locks on the door are not the same thing.  You can't replace the lock with a new lock to which they do not have a key.  Not unless you get an eviction through the court.

But no judge is going to argue that you should leave a place open and unsecured.  You have the right to protect your property from squatters and property damage.  Feel free to lock whatever locks are on the doors.  If they turned in keys, they don't have the right to go back and enter the property.  They gave you possession when they turned in keys.  If he no longer has a key, have him contact you to get back into a property he was not living in for the past 2 months.

If there is only one door with a key, take the boards off that door, secure the open door, and lock the door with the existing lock.
