Here is the situation. Tenant living at duplex unit paid for by section 8. In jan the other side caught on fire but no damage to the other side per fire dept. However for some reason these people stayed in a hotel for what i believed was 2 weeks. In march Section 8 kicked them off section 8 for violation of thier rules (March rent was paid). The renants said they will be out by March 31 as they could not pay for the rent themselves. Of course they did not move out by march 31. I had given them a 24 hour notice to enter the last wkd in march and when i went inside found out the water ang gas were no longer on. a neighbor said they had seen a shut off notice for gas approx a month or two ago. I also witnessed molded food such as oranges, potatoes and loaf of bread. In my lease there is a clause for abandonment which states 7 days. i posted a reclaim or forfiet letter on the door after 7 days and contacted the tenants by text (they wont answer phone calls) they keep saying they will be out that day but never come to get anything. on the 10th i went to the residence to show the rental, inspect it and paint (i put up another 24 hr notice just to cover my butt) this time i found milk in the fridge dated to march 10 and more rotted food in the fridge. the tenants called the police because i was in the unit (apparently they drove buy when i was there). They admitted to the police that they have not been living there since Jan. Now i know i can only claim abandonment starting in april because althou they werent living there section 8 paid thier march rent.
what is the abandonment law for ohio? can i remove thier belongings and if so do i have to store it? i would like to remove thier belongings so i can rerent it. They have come and gotten thier 65 inch flat screen tv, thier deep freezer and several bags of things. But mainly the entire rental is full. Everyday they tell me they are going there to get everything, but then later they have an emergency and will do it tommorow. Also now they are telling people and other tenants that i entered without permission and stole $9k worth of stuff. please help

In a nutshell... There isn't one. Ohio legislators never got around to writing or passing one. Serve a 3 day notice to leave premises upon the door, and file to evict as soon as it expires. Quit calling. Have no contact with them. Once you get the eviction, ask for an immediate set out since the utilities are all off and the unit is uninhabitable. Don't remove their things in the meantime. Let the sheriff set their belongings out, then you can retake possession.
